This Promotion is open to residents of the United Kingdom and the Republic of Ireland aged 18 or over, excluding employees of the Promoter, its agents and anyone professionally associated with this Promotion.
No purchase necessary; however, internet access and a valid email address are required. The Promoter is not responsible for internet access or validity of email address.
Promotion Period:Submit your photo between 00.01 BST on the 19 September 2023 and 23.59 BST on the 16 October 2023 inclusive.
Enter your name, email address and upload your photo incorporating a Cadbury product and/or the Cadbury logo already incorporated within the original image for the chance to have your photo included in the Cadbury 200 year anniversary campaign.
The photo must be in compliance with the Eligible Participation Guidelines stated in Clause 5 below.
The photo uploaded must be in the PNG or JPEG file format, and the photo size is limited to a minimum of 1MB and maximum of 5MB.
You must complete all the above steps (Clause 4a – d) to participate.
Eligible Participation Guidelines:The uploaded photos must comply with the following guidelines and undergo Moderation in order to be eligible for selection:
Group photos can be submitted, however by submitting a group photo for the Promotion the submitter declares they have received the consent of the other people featured in the group photo prior to submission or consent from the next of kin for any deceased individuals featured.
Where a submitter submits a group photo featuring a Minor/Minors, consent from a person who is the parent or the legal guardian for that Minor/s must be obtained by the submitter in relation to each Minor/s who is featured prior to submission. The Promoter may require proof of this to be produced by the submitter.
Submitters must only upload images that do not infringe or violate the rights of any third party, including but not limited to, ownership, copyrights, trademarks, patents, logos, licensing rights, rights of publicity or privacy or any other intellectual property rights or any other requirements of applicable legislation.
Submissions must not disparage the Promoter, or any other person or party affiliated with the promotion.
Submissions must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libellous.
Submissions must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
You agree to grant the Promoter in perpetuity a non-revocable, worldwide, royalty-free license to use the copyright and other intellectual property rights vesting in your entry for all purposes connected with this Promotion, including but not limited to display on the Promoter’s website, social channels, in any publicity, advertisement or case study carried out by or on behalf of the Promoter in any manner or medium whatsoever, including print, broadcast or the internet and any other website of the Promoter or its agents/contractors choosing and use of the submission, or part(s) of the submission in marketing materials relating to this Promotion.
Each Submitter also grants the Promoter and its agents/contractors the right to moderate, edit, modify or remove any submission in the Promoter’s, its agents or assignees’ sole discretion, in whole or in part, for display on the Promotion website or in any materials relating to the Promotion.
You agree to the inclusion, publication, reproduction and/or other use of your entry by the Promoter in any Media.
Photos created by any form of artificial intelligence will be disqualified.
Any images where a Cadbury logo has been retrospectively incorporated, artificially or digitally inserted or edited, will not be eligible for selection.
Any Cadbury logos must be located in-situ on the frame and must not be artificially or digitally inserted or edited.
In the event that a submission violates any of the above Eligible Participation Guidelines, the Promoter may (at their sole discretion) crop or edit such submission to render it compliant and / or exclude such submission from the Promotion.
In the event a submission has been removed for breaching the Eligible Participation Guidelines, the submitter may make another submission, provided they do so within the Promotion Period. There is no limit to the number of submissions to be made per person during the Promotion Period. There is no limit to the number of rewards that each submitter may receive but a maximum of 1 reward can be awarded per selected submission.
The Reward: A minimum of 3 submissions will be selected for use by the Promoter and/or its agents in any media promoting Cadbury’s 200 year anniversary campaign, subject to a valid Photo Release form being signed by the submitter and/or any third parties featured in the photo. Each eligible submitter of a selected photo will receive:
1 x £1000 or euro equivalent; and
1 x Cadbury hamper valued at £35.
Claiming the Reward:
If an eligible submitter’s photo is selected for use in the campaign, they must sign the Photo Release Form and must obtain a signed Photo Release from:
Any third-party person featured in your uploaded photo.
Any person who has parental responsibility is the parent or is the legal guardian for any person or persons under the age of majority in their country of residence (Minor/s) featured in your uploaded photo.
The next of kin of any individual who has deceased who is featured in the photo.
The Promoter will not use a photo in the campaign unless it has obtained signed Photo Release Forms from, or on behalf of, all individuals featured in the photo and submitters will not be eligible for the Reward mentioned in clause 7.
Further Details and Conditions:
If an eligible submitter’s photo is selected, the Promoter and its agents will have content usage rights over the photo (as per the rights outlined in clause 6g. and 6h.).
The £1000 cash will be paid via BACS to the submitter of the selected submission only.
The submitter is responsible for providing correct bank account details and the Promoter will not be liable for any payments made into the wrong bank account.
The submitter must have a valid UK or Irish bank account.

Selection: All valid entries received during the Promotion Period (subject to moderation) will be judged by a panel of judges, including an independent party, by the 27th October 2023 to select a minimum of 3 photos based on the following criteria:
High quality image – Does the image have a high resolution? (scored out of 20)
Originality – How original is the entry, does it stand out from other entries? (scored out of 5)
200 Years of Cadbury – Does the image encapsulate 200 Years of Cadbury? (scored out of 5)
If more than 3 photos get selected, the additional eligible submitters will receive the same Reward stipulated under Clause 7.
Notification: If an eligible submitter’s photo is selected, the Promoter’s agents will notify the submitter by sending an email to the submitter via the email supplied on entry by the 6th November 2023. The Promoter and its agents will not notify any submitter if their photo will not be used in the Cadbury 200 year anniversary campaign. If the Promoter and its agents select a submitter’s photo for use in the campaign, their photo will be displayed in any media published by the Promoter and/or its agents promoting the 2024 Cadbury’s 200 year anniversary campaign.
Moderation:The Promoter reserves the right to reject submissions which, in the reasonable opinion of the Promoter:
are in breach of the Terms & Conditions;
contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;
contains or refers to any unauthorised third-party brand or reference any third-party names, logos and/or trademarks;
promotes any political agenda.
contain defamatory, malicious, indecent or other inappropriate content including sexist or racist language or imagery;
include the names, likenesses, photographs or similar of any individual without their express permission;
contain immoral or obscene behaviour;
condone or encourage violent or anti-social behaviour;
cause offence on the ground of religion, gender, sexual orientation, nudity, disability or age;
represent a danger to health and safety or cause fear or distress;
contains any AI image generated content.
Provided no objection is received, the surname and county of the submitters whose photos are selected will be made available to anyone who requests them by writing to JS13915 Cadbury 200 Years, PO Box 704, Pinner, HA5 9PF, within 3 months of the closing date. In the event they are selected, submitters may request their surname and county are not published or request for the amount of information being published to be reduced during Notification process. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on reasonable request.
The Promoter may request that the submitters participate/s in publicity arising from the Promotion. Participation in publicity is at the submitter’s discretion and is not a condition of acceptance of these Terms & Conditions.
The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Reward awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
Verify the submitters through multiple means by requesting such information it considers reasonably necessary for this purpose. Reward may be withheld until verification is completed.
Disqualify submitters that are not made directly by the individual participating in the Promotion.
Disqualify bulk submissions from individuals, trade, consumer groups or third parties, incomplete submissions and those submitted by macros or other automated means.
Disqualify submitters who tamper with the submission process.
Disqualify submissions which, in some other way, do not meet the requirements of these Terms & Conditions.
Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
The Rewards are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason any element of a Reward is not available, the Promoter reserves the right, at its sole discretion to substitute another Reward for it, of equal or greater value.
No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS13915), except for any liability which cannot be excluded by law. Nothing will exclude the Promoter's liability for death or personal injury as a result of its negligence.
The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.
The Promoter shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation 2016 and any successor legislation or other applicable law. The personal information entrants provide will be used by the Promoter for the purpose of conducting this promotion and in accordance with the Promoters’ Data Privacy Notice which can be found at https://eu.mondelezinternational.com/privacy-notice. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion (including any relevant promotional activity) or communicating with entrants.
If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.
If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
These Terms & Conditions are governed by English and Irish law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England, Wales and the Republic of Ireland. Residents of Scotland and Northern Ireland may bring proceedings in their own jurisdiction.
